ormer President Donald Trump is facing trial again in New York this week to determine additional damages for defaming former Elle magazine columnist E. Jean Carroll in 2019 when he denied her sexual assault allegations.

A federal jury will begin deciding how much the former president owes the writer. It’s the second trial to be held in a pair of cases against Trump brought by Carroll.

In a prior civil lawsuit, Carroll accused Trump of raping her in a Bergdorf Goodman dressing room nearly 30 years ago and defaming her. Last year, a jury ruled in favor of Carroll, finding Trump liable for sexual abuse and defamation, and awarded her $5 million in damages.

“The jury has the power to impose substantial punitive damages on Trump for raping Ms. Carroll, then branding her accusation as made-up and then repeatedly castigating her in public and social posts as crazy and ‘whacky,’” Bennett Gershman, a former New York prosecutor and law professor at Pace University, told Salon.

The longtime advice columnist for Elle magazine first came forward with the allegations in an excerpt from her book in New York Magazine. Then-President Trump accused Carroll of fabricating a story to ....

ormer President Donald Trump fired off more than 30 posts in 40 minutes targeting E. Jean Carroll as his second defamation trial got underway Tuesday as the two appeared in the same room together for the first time in years, according to CNN. Trump lobbed a flurry of attacks at Carroll and the federal judge presiding over the ex-columnist's defamation trial against the former president. "I am waiting to get into the courtroom for the Carroll proceedings, but the bizarre advantage of still being outside is learning Trump has yet again defamed Carroll on Truth Social," MSNBC legal analyst Lisa Rubin reported.

In one post, which he later reposted, Trump wrote, "Can you believe I have to defend myself against this woman’s fake story?!” over a video clip of Carroll. He also authored several posts raging at the writer and U.S. District Court Judge Lewis Kaplan, who last week applied restrictions on what Trump and his lawyers could discuss during the trial, dubbing Carroll's lawsuit "attempted extortion" in one and in others accusing Kaplan of hating him and calling on the judge to "put this whole corrupt, Crooked Joe Biden-directed Election Interference attack on me immediately to rest." Trump also shared more than a dozen screenshots of what appear to be posts about sex from Carroll's social media accounts.

"Trump's Truth Social account is mass attacking E. Jean Carroll while he sits (phoneless) in court and prospective jurors are beginning to gather," Politico's Kyle Cheney wrote on X, formerly Twitter, citing Politico reporter Erica Orden. "We'll see what, if anything, Judge Kaplan has to say about this..." Orden added. Last Wednesday, Kaplan barred Trump and his team from — among other matters — denying he sexually abused Carroll, holding that "the material facts concerning the alleged sexual assault already have been determined, and this trial will not be a ‘do over’ of the previous trial."

U.S. legislators would prefer not to have such a statutory prohibition, in case they find themselves in such situation.

I suspect / hope the law judge self-restrains here to avoid the backlash that would result from restraining Trump, if for example Trump's bail was revoked, & Trump incarcerated.

But it does bear at least the superficial appearance of judicial cowardice.

Carroll has now twice successfully sued Trump in civil court. All of the former president’s rantings and ravings about Carroll online and at his rallies did little more than strengthen the plaintiff’s argument that ....

When you file an appeal in NY, you may have to put up the amount of judgment for court to hold for the length of the appeal process... and pay the interest earned. So he's already put up the 5 million from the original case. So court has it. Same if he appeals this 83 million. For scale, his Park Ave bldg is valued at 84 million.

There's also the NY fraud trial judgment amount, which could be upwards of $370 million. It's believed that Trump doesn't have that kind of cash in the bank. His net worth is in real estate. He'll either have to sell assets or declare bankruptcy. At which point the state will take his assets and fire sale them just to get the money.

I doubt Trump's experience as a politician met his most indulgent fantasies. But I doubt Trump ever ruled out " a legal shield for life if he wins in 2024" or a 2nd term if Biden hadn't beat him.
What Trump might have wished to keep secret is his reasoning. Trump might prefer to not go nucular, but better that than prison.

Former President Donald Trump's appeal of the $83.3 million verdict in the defamation case brought by E. Jean Carroll is unlikely to succeed, legal experts say.

"Let me ruin the suspense for everyone. Trump doesn't have an appeal," Nashville lawyer Brian Manookian argued Friday. "I know the talking heads on TV who have never tried a case or appealed a jury verdict have to mention it. Here's why it isn't going to fly."

A person must "preserve a reversible error at the trial level" in order to have a case with merit on appeal, Manookian explained, ultimately blaming Trump's lack thereof on his legal team in the case.

"This is why you hire competent counsel. You need someone who actually knows the rules of evidence and procedure," he said. "Alina Habba had no clue what was occurring throughout the trial. She not only failed to preserve any remote grounds for appeal, like a moron, she repeatedly and unintentionally ....

Trump has a reputation for not paying those that have served him well.
Some reports indicate Trump has literally thousands of court cases in his own history.

So it seems plausible Trump exhausted his supply of competent representation, and ended up scraping the bottom of the barrel for this trial. DJ ! It's called "karma".

When a trial attorney has the facts & the law on his side he pounds the facts and the law.
When not, he pounds the table.

If Trump had a legitimate argument here, his legal team could make that argument at trial, persuasively, and win the case.
Since not, yell.

Trump is a desperate man. Many interesting books will be written about these Trump years, and the bizarre egotism driving him. So far, the newspaper accounts are "exciting". So is falling off a bridge.
